Terms of Service

Provider: Distortion Labs SAS ("Distortion Labs", "we", "us") — a French simplified joint-stock company (SAS), share capital €5,000, registered with the Paris Trade and Companies Register (RCS Paris) under No. 921 758 694, registered office at 66 avenue des Champs-Élysées, 75008 Paris, France, intra-community VAT FR94921758694. Service: the damn.dev platform and the damn.dev managed-hosting service at damn.dev. Effective date: 1 June 2026

By creating an account or purchasing a subscription, you agree to these Terms. They also serve as our terms of sale.

1. The service

damn.dev is a self-hostable platform for human + AI-agent collaboration, offered three ways:

  • Self-host (licensed): the self-hostable software, which you install and run on your own infrastructure under our License (governance and observation at no charge; running agents requires a licence). These Terms do not govern self-hosting, except as they reference that licence and our trademarks.
  • Managed hosting (paid): we provision and operate a dedicated server running damn.dev on your behalf. You remain the sole administrator of your instance.
  • Studio (bespoke): custom design, build and deployment engagements, governed by a separate agreement and not by these Terms.

These Terms govern the managed-hosting service and your account.

2. Accounts

You must provide accurate information, be of the age of majority, safeguard your credentials, and are responsible for all activity under your account. Notify us promptly of any unauthorised use.

3. Subscriptions, billing & price changes

  • Managed hosting is sold as a monthly or annual subscription, billed in advance through our payment processor Stripe. Applicable taxes (incl. VAT) are added.
  • Subscriptions renew automatically at the end of each period unless cancelled (§4).
  • We may change prices; existing subscribers get at least 30 days' notice by email before a change applies to their next renewal.
  • Non-payment may lead to suspension or termination of the managed instance.

4. Cancellation

You may cancel at any time from your account or by emailing [email protected]. Cancellation takes effect at the end of the current billing period; your instance remains available until then. Refund terms are in the Refund & Cancellation Policy.

5. Your data & your instance

  • You own your data — content, agents, workspaces and configurations in your instance are yours.
  • Your instance runs on a dedicated server allocated to you. We do not read or use the contents of your workspace — the only data we process is what you share with us (account, billing, support). We do not log in to your instance to view its contents; any support access happens only with your explicit, time-limited and logged consent. We retain infrastructure-level access to the underlying server for security and disaster recovery, used only as necessary and never to read your workspace data.
  • Backups are your responsibility unless a backup feature is explicitly included in your plan.
  • The personal data we process and our controller/processor roles are described in the Privacy Policy.

6. Acceptable use

You must not use the service to break the law; infringe others' rights; send spam or malware; gain unauthorised access to systems; or operate illegal, fraudulent or harmful content. You are responsible for the actions of the agents you configure on your instance.

7. Third-party model providers

Your agents may call third-party AI providers (e.g. OpenAI, Anthropic, OpenRouter, Ollama) that you choose and configure. Data you send to them is governed by their terms; we are not responsible for those providers.

8. Software & trademarks

The damn.dev software is proprietary and self-hostable under our License; these Terms do not limit your rights under that licence. In short, that licence lets you run damn.dev for your own operations (governance and observation at no charge; running agents requires a licence), but does not allow reselling, offering damn.dev as a hosted service to third parties, redistributing or modifying the software, or removing our branding — those require a separate written agreement. The "damn.dev" name, logos and trademarks remain the property of Distortion Labs SAS.

9. Availability & support

The managed service is provided on a commercially reasonable-effort basis. We do not guarantee uninterrupted or error-free operation. Support is provided by email on a reasonable-effort basis (priority support on the Team plan).

10. Warranties & disclaimer

The service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law, except warranties that cannot be excluded under French law (including the legal guarantees of conformity for consumers).

11. Limitation of liability

To the extent permitted by law, Distortion Labs is not liable for indirect, incidental, special or consequential damages, or for loss of data not attributable to us. Our total aggregate liability for any claim is limited to the amounts you paid for the service in the 12 months before the event giving rise to the claim. Nothing excludes or limits liability that cannot be limited under French law.

12. Termination by us

We may suspend or terminate the service for material breach (incl. non-payment or abuse), with notice where practicable. On termination we will, on request and where feasible, make your data available for export for a reasonable period before deletion.

13. Changes to these Terms

We may update these Terms; material changes are notified by email or on the site. Continued use after the changes take effect constitutes acceptance.

14. Governing law & disputes

These Terms are governed by French law. Consumers keep the benefit of the mandatory protections of their country of residence and may use the EU Online Dispute Resolution platform (ec.europa.eu/consumers/odr). Failing amicable resolution, disputes fall under the competent courts of Paris, France, subject to mandatory consumer-jurisdiction rules.
